What Is An EXPEDITED DIVORCE (DIVORCE VIA E-FILE)?
An Expedited Divorce (Divorce Via E-File) is when APS will prepare ALL the divorce papers in advance!
This means, on the day of the appointment You and Your Spouse can sign ALL the divorce papers AND the divorce papers will ALL be E-FILED in Court within 1 - 2 business days after our meeting. That's It!
NOTE: Some of the documents will require You and Your Spouse to sign before a notary. Because Anderson Paralegal Services, Inc is a NYS Notary, this service will be included in the meeting free of charge.
THIS IS HOW IT WORKS:
FIRST - Your SUMMONS WITH NOTICE (this is the document to start your case in Court) is uploaded onto the Court's website. This is when you will pay the Court's first filing fee of $210 for the INDEX NUMBER. The E-file County Clerk normally will issue you the Assigned Index Number via e-mail the same day or one (1) business day AFTER the Summons With Notice has been received and reviewed.
SECOND - After the Assigned Index Number has been received by you, APS will make an appointment for You and Your Spouse to meet up to sign the divorce documents before a notary. The meeting will be between 5 - 10 minutes.
THIRD - ALL the divorce papers will be UPLOADED onto the Court's website within 1 - 2 business days after our meeting. That's It!!!
(Note: This is when you will pay the Court second filing fee of $125.)
Note: Occasionally, it may take a little bit longer than one (1) business day to receive the Assigned Index Number from the E-file County Clerk (e.g. it may take two business days to receive the Assigned Index Number).
What are the BENEFITS for an Expedited Divorce?
HERE ARE THE BENEFITS FOR AN EXPEDITED DIVORCE:
1. On the day of the appointment, ALL the divorce documents will be completed and ready to obtain You and Your Spouse's signatures.
2. You and Your Spouse can sign the divorce papers at the same time before a notary and be done! No more papers to sign. Because APS is a NYS Notary, this service will be included in the meeting free of charge.
3. The meeting will be between 5 - 10 minutes.
4. All the divorce documents will be E-FILED in Court within 1 - 2 business days after our meeting.
5. Upon the filing of the divorce papers in Court, you're simply waiting for the Court to get to your case.
6. Because your divorce is via E-FILE, you (not APS) will receive e-mails from the Court when the Court gets to your case and begin to process the divorce documents. In addition, you will receive a detailed e-mail from APS containing the instructions on how to follow up on your case with the Court as well.
7. You will have complete access to your ENTIRE FILE online 24 hours a day 7 days a week.
8. If your papers get "rejected" by the Court (sometimes the Court does make a mistake or may have a question), some Counties such as NEW YORK COUNTY (Manhattan) and KINGS COUNTY (Brooklyn) will require you to travel all the way to the Court in person and go to the Matrimonial Department to obtain a letter from the Judge explaining why your divorce papers were rejected and what to do to fix it.
If your divorce is E-FILED, then the "rejection letter" will simply be in your online account to print out and review, with no trips to and from the Court.
9. GREAT NEWS...When the Court gets to your case and finalized your divorce, the DIVORCE DECREE (signed by the Judge) will be in your online account.
This means when you logged into your account, you will be able to see the signed DIVORCE DECREE and can print out as many copies as you may need, all taking place from the comfort of your home.
Note: The Court does not expedite the divorce (unless you present some sort of an "emergency" for the Court to consider). This means, you will still have to wait patiently for the Court to get to your case.
So, if You and Your spouse would like to sign ALL the divorce papers before a notary on the same day, at the same time, the appointment requiring 5 - 10 minutes of your time and have the divorce papers ALL filed in Court within 1 - 2 business days after the meeting, then an Expedited Divorce is what you want to do!
