(listed below), that you qualify for:  

• New! No-Fault: (the relationship has broken down irretrievably  
for at least 6 months)

• Abandonment: (you have not lived together for at least 1 year)

• Sexual Abandonment: (you have not had sex with your
spouse for at least a year)

• Separation Agreement: (you have lived apart for at least one
year pursuant to (a) a judgment of separation or (b) a written &
filed separation agreement)

• Imprisonment: (your spouse has been imprisoned for at least
three [3] consecutive years after you were married)

• Adultery: (you will need the testimony of a witness to the
adultery EVEN with your spouse's admission, and only if it has
been less than 5 years since you found out)

• Cruel & Inhuman Treatment: (your spouse treated you so
badly that it endangered your physical or mental health. You will
need to specify exact dates, places and details of the cruel &
inhuman treatment)

Requirements” (listed below), that you qualify for
(i.e. Choice 1, 2, 3, 4, 5, or 6):

1) Plaintiff has been a resident of New York for a continuous
period of at least two years immediately preceding filing for
divorce.

2) Defendant has been a resident of New York for a continuous
period of at least two years immediately preceding filing for
divorce.

3) The grounds for divorce occurred in New York, and both
parties were residents of New York at the time of filing for
divorce.

4) Both spouses were married in New York as husband and
wife, and either spouse is and has been a resident of New York
for a continuous period of one year immediately preceding the
divorce action.

5) Both spouses have resided in New York as husband and
wife, and either spouse is a resident of New York when the
action commenced, and has been a resident of New York for a
continuous period of a year immediately preceding the action.

6) The grounds for divorce occurred in New York, and either
spouse has been a resident of New York for a continuous
period of one year before filing for divorce.
